IMPORTANT NOTE
The software, as defined below, is protected by copyright which is
vested in Compware.
License keys, as defined below, are protected by copyright which is
vested in Compware.
The sofware and license keys may only be used in accordance with
the terms and conditions set out in this document.
If you do not read and agree to be bound by the terms and conditions
defined in this document then you are not permitted to keep or use
the software or license keys in any way whatsoever and must destroy
or return all copies of these items which are in your posession.
Definitions
-----------
The following definitions apply to the terms and conditions included in
this document.
the software
means all program and information files and other documentation which are
part of the Agile HTML Editor package, with the exception of license
keys which are not part of the software.
a license key
is a code which is used to control the features available in the software,
but is not itself part of the software
an individual
means a particular person.
a use of the software
means use of the software on one or more computers by a single
individual. Where the software is used by more than one person, then
this will constitute multiple uses where the number of uses will be equal
to the number of individuals able to access to the software even if
not all of the individuals with access make use of the software.
License Terms and Conditions
----------------------------
The whole of this document constitutes the terms and conditions under
which Compware permits the software to be stored, copied, distributed
and used. Headings and punctuation serve only to assist the reader.
The laws of England shall apply to the terms and conditions set out in
this document, and to all licenses granted on the basis of the terms
and conditions.
Any dispute related to the terms and conditions shall either be subject
to the courts of England or to the courts of the country of the individual
or organisation which is in dispute with Compware, where the choice of
country will be made solely by Compware.
Each individual who uses the software requires a license. Where more than
one individual will use the software, or where the software is made
accessible to multiple individuals, for example by installing it on a
network, then this will constitute a multiple use of the software and
will require one license for each use.
A license permits a single use of the software.
A free license, permitting restricted use of the software, is hereby
granted to any person or organisation agreeing to abide by the terms
and conditions of this document. The aforementioned free license
permits use of only those features of software which are intended
by Compware to be available without installation of a license key.
Details of these features are available from Compware upon written
request, but may be varied without notification.
An evaluation license is available for the purpose of trying the software
prior to deciding whether or not to purchase a product license. An
evaluation license may permit use of all or a subset of features of the
software, deemed by Compware to be sufficient for evaluation. Any
organisation or individual may apply for a single evaluation license,
which if granted will entitle them to a single use of the software for
a limited period of time. This limited period will last until the evaluation
license key expires, or until 30 invokations of the software, or until 30
days after first use of the software, whichever occurs first. Only one
evaluation license may be applied for or used per individual or
organisation. Once an evaluation license has expired an individual or
organisation must cease to use the software, or must have purchased sufficient
product licenses for its use(s) of the software.
A product license permits a single use of the software for an indefinite
period provided that the purchaser and all users of the software comply with
the terms and conditions set out in this document. Non compliance with any of
these terms and conditions or any other breach of the copyright vested in
Compware shall immediately invalidate the product license without compensation
or refund being due to the purchaser of the product license.
The purchaser of a product license will be responsible for ensuring that
all uses of the software comply with the terms and conditions described
in this document.
It is the responsibility of any individual or organisation using the
software to ensure that their use of the software is not in breach of the
copyright of any party whose material is received or processed using the
software.
Copying and Distribution
The software may be freely copied, stored and distributed by any person or
organisation, providing that the person or organisation meets the terms and
conditions of this document in full.
Modification of the software, and storage, distribution and copying of
modifications to the software is prohibited.
License keys may be used in conjunction with the software only by the person
or organisation which purchased the associated product license. Neither
a license nor a license key may be transferred from the original end user
purchaser to any third party.
License keys are not part of the software and may be stored or copied
only by the person or organisation which purchased the associated license,
and providing that the terms of the associated license are met in full.
Such storage or copying shall be permitted solely for the purpose of
using the software within the terms and conditions of this document.
No person or organisation is permitted to store or copy a license key for
any other purpose without written agreement from Compware.
The copyright of all license keys remains vested in Compware which reserves
the right to withold or withdraw authorisation of use of all license keys
issued to a person or organisation if there is reasonable evidence to indicate
that the person or organisation is involved in a breach of the terms of this
document.
Warranty and Liability
Compware warrants that the media on which the software is distributed
shall be free from defects and will replace defective media free of
charge, on return of the defective item.
Compware has taken care in the design implementation and testing of the
software, but the complex nature of computer software makes it impossible
for us to warrant that it will not contain significant errors, or that it
will function as intended in all circumstances.
Compware accepts no liability for any loss or damage resulting from the use
of the software, regardless of whether or not any loss or damage was caused
through negligent or accidental inclusion of features or errors in the
software. This exclusion of liability shall extend to the distribution
of damaging programs, not authored by Compware, including but not limited to
computer viruses and trojan horse programs.
Variation
Any variation to the terms of this document shall only be valid if made in
writing by Compware.
